AAT Appeals & Reviews

Overcoming Visa Refusals with the Help of the Administrative Appeals Tribunal
Applying for an Australian visa is a journey filled with aspirations. But sometimes, the path takes an unexpected turn — a visa refusal. This can happen due to eligibility issues or administrative oversights, leaving your Australian dream on hold.
Fortunately, there’s hope. Australia’s Administrative Appeals Tribunal (AAT) gives you the chance to have your case reviewed fairly. With CG Migration Services by your side, you don’t face the process alone — we provide expert guidance to help you challenge decisions and move closer to achieving your goals.
The Role of the AAT
The Administrative Appeals Tribunal (AAT) reviews visa decisions made by the Department of Home Affairs under the Migration Act 1958. It operates as an independent body, ensuring fairness and transparency.
- Visa refusals or cancellations across various categories.
- Refusals of nominations for occupations, positions, or activities.
- Protection visa claims from asylum seekers.
- Sponsor approvals that are refused, barred, or cancelled.
- The Minister for Immigration or Home Affairs has personally reviewed the application.
- The case falls outside AAT’s reviewing powers.
- Uphold the Department’s original decision.
- Modify the decision.
- Replace it with a new decision.
- Refer it back to the Department for reassessment.
Navigating the AAT Visa Appeal Process
If you’ve received a visa refusal, here’s how the AAT appeal works:
- Your refusal letter will confirm if you can appeal and the timeframe.
- 7 days for those in immigration detention.
- 28 days for other applicants.
- Appeals can be lodged online or via paper.
- Online appeals provide instant acknowledgment and easier document management.
- Standard fee: AUD $1,826.
- A 50% reduction may apply in cases of financial hardship (apply with Form M11).
- If your appeal is successful, you may be refunded 50%.
- Hearings may be conducted formally or informally.
- If you receive an invitation, you must respond within 7 days using the Response to Hearing Invitation form.
